The building's owner, Wassim Mohammad Azizi, failed to notify the Environmental Protection Agency that during demolition potentially hazardous asbestos fibers might be released into the air, causing asbestosis or mesothelioma. Asbestosis is a progressive pulmonary disorder, whereas malignant mesothelioma is a rare cancer that typically affects the mesothelium, the lining of the lungs, heart, or abdomen. During the jury trial, testimony revealed that Azizi hired an unlicensed worker to tear down the Hayward building knowing that it contained toxic materials. Most state laws required that asbestos be removed from buildings before they are demolished. Furthermore, public health laws dictate that special safety techniques must be taken to prevent dispersal of airborne asbestos fibers.
