Mesothelioma attorneys caution that asbestos fibers released into the air increases developing a deadly form of lung cancer. The workers removed the boiler without wearing protective gear. They did not seal the area, and asbestos fibers were released into the air when the workers dropped the boiler and the insulation crumbled. Although the workers cleaned up the area they did not wear protective gloves and disposed of the toxic asbestos in black trash bags, which are insufficient protection.
Strict rules specify that asbestos removal requires trained workmen, a containment area, air filtration equipment and correct packaging and labeling of asbestos waste. Contamination of the work site can lead to costly clean up procedures, according to the Massachusetts Department of Environmental Protection.
Sears is required to develop and implement a training program for asbestos removal and to increase supervision on all jobs where asbestos may be involved.
