After more than a decade, asbestos bankruptcy Judge Judith Fitzgerald of the U.S. Bankruptcy Court for the District of Delaware has approved W.R. Grace’s reorganization plan, (In re: W.R. Grace & Co, U.S. District Court, District of Delaware, No. 11-00199 and W.R. Grace & Co, U.S. Bankruptcy Court, District of Delaware, No. 01-01139) easing the way for those injured by asbestos to finally pursue compensation for asbestos-related lawsuits and claims. The final step remaining now is a confirmation order by the district court, which is anticipated to occur rather quickly in the next month or two.

The impact of this approval is that those injured by asbestos products related to Grace and their surviving family members can now file their claims against the company, and if the claims are approved, receive significant payments for their illnesses and loss of life.

When a company files for bankruptcy, they can no longer be sued in the tort system and all lawsuits and claims are suspended pending a decision by the Bankruptcy Court, which must approve of a plan of reorganization. W.R. Grace first sought bankruptcy protection in 2001, when increasing numbers of asbestos personal-injury claims drove them to seek Chapter 11 relief.
