Jan 2, 2009 - Father Dies of Mesothelioma - Sons File Suit against Chevron
Four brothers have filed an asbestos suit against Chevron and Gulf Oil on behalf of their father, Gliese Bergeron, who died of mesotheliomaon Oct. 31, 2008. The suit claims that their father was exposed to asbestos during his employment. As a result of that exposure, he developed pleural mesothelioma, an asbestos-related lung disease in which fibers become lodged in the lining of the lungs. Asbestos was often used in industrial products such as cement, brake linings, floor and ceiling products, and insulation.
The Bergeron brothers believe that Gliese’s exposure occurred when he worked as an insulator, pipe fitter, operator, and maintenance worker for Chevron and Gulf Oil between 1942 and 1983. They say Chevron should have known and warned plant workers about the risk of exposure to asbestos on the jobsite and failed to take precautionary actions such as:
air quality testing and monitoring for concentrations of airborne asbestos fibers
educate and train employees on health hazards of asbestos
provide protective equipment and implement safeguards to protect workers
instruct workers on proper removal and handling of asbestos containing products
The brothers claim that Chevron was aware of the dangers of asbestos, that asbestos containing products were used in their facilities, and that they did not adequately safeguard their workers against exposure to the hazardous material. They have filed suit in the Texas 60th District Court.
